Legislation Changes

Did you know that consumer rights have changed?

In 2015, new legislation called The Consumer Rights Act (CRA) 2015 came into effect, whereby all Consumers gain extra power against the Sellers, regardless of whether the purchase is made in-store, online or elsewhere.

The Consumer Rights Act consisted previously of eight separate documents, which have now been consolidated into one, making it much easier to access and understand.

How does it affect me?

  • Contracts need to clearly state the details of the purchase and price in a transparent way and the use of small print is not allowed.
  • Cooling off period is a minimum of 14 calendar days and no reason for cancellation is necessary. Costs incurred in the process are carried by the seller.
  • No deposits or advanced payments are allowed to be taken during the cooling off period.
  • Traders will receive penalties if the regulations are not adhered to.
  • In case of a cancellation, any accompanying finance and loan agreements are cancelled automatically.
  • Across the EU, legislation is harmonised and contracts have to be in a language of the Consumers choice.

How is Timeshare affected?

Included in the CRA 2015 are:

  • Long term holiday products and clubs.
  • Short term contracts including renewals.
  • Timeshare style products for the duration of fewer than three years are included (previously did not apply for over three years). Canal boats, yachts, cruise ships and caravan style timeshare products are also included.
  • Timeshare release and exchange schemes.
  • Long and short term holiday products are not to be sold as investments.
